AI and Dispute Resolution at the AAA‑ICDR Future of Dispute Resolution Conference
How will AI reshape mediation and arbitration?
At the American Arbitration Association’s 2025 “Future of Dispute Resolution” conference, global leaders from Europe, North America and the Middle East examined AI’s impact on ADR. Speakers emphasised the need for ethics and transparency when using AI tools and predicted that technology would transform how evidence is reviewed and arguments are presented. Yet they also cautioned that human oversight remains essential.
Legal analysis: As AI systems assist with document review, translation and even drafting awards, arbitral institutions are grappling with best‑practice guidelines. The CIArb and SVAMC recommend that parties agree on disclosure obligations and ensure AI tools do not compromise due process or confidentiality. Drafting clear AI‑disclosure clauses in arbitration agreements will reduce challenges down the line.
