The New JAMS AI Rules

Recognising that conventional court litigation struggles to keep pace, Judicial Arbitration and Mediation Services (JAMS) has introduced its Artificial Intelligence Dispute Rules. Effective 14 June 2024, these rules are tailored specifically for AI‑related disputes and were profiled by JAMS ADR Insights in February 2025.
The rules leverage the hallmarks of arbitration (speed, flexibility and confidentiality) while encouraging parties to select arbitrators with specialised technical expertise. Importantly, they impose a heightened confidentiality obligation on all parties and counsel, ensuring that sensitive AI algorithms and data remain protected. By crafting sector‑specific procedures ahead of litigation, JAMS demonstrates how ADR can adapt to emerging technologies.
These rules underscore arbitration’s advantages for tech disputes; customised procedure, technical expertise, and confidentiality. The rules go beyond JAMS’ standard arbitration rules by requiring all participants, not just the tribunal, to maintain confidentiality, and they include a model dispute‑resolution clause that parties can insert into contracts. Incorporating such clauses early allows technology companies to avoid unclear jurisdictional fights later and ensures disputes are decided by arbitrators versed in AI.
